As used in this subchapter, the following definitions apply: (1) “Abandoned mine lands” or “AML” means lands and waters, including associated watersheds, where extraction, beneficiation, or processing of ores or minerals occurred at coal mining operations abandoned or inadequately reclaimed before August 3, 1977, or at non‑coal mining operations abandoned or inadequately reclaimed before August 3, 1977, for which there is no continuing reclamation responsibility under state or federal law, and that are eligible for reclamation or drainage abatement under the department’s abandoned mine lands program as approved under 30 CFR 926.20. (2) “Dangerous impoundment” means a surface or underground water, slurry, or similar impoundment related to mining that poses a threat to public safety, property, or the environment. (3) “Dangerous slide” means slope instability, mass movement, or similar ground failure associated with AML features that pose a threat to public safety, property, or the environment. (4) “Hazardous waste” has the meaning given in 40 CFR Part 261. (5) “Subsidence” has the meaning given in 82-4-203, MCA.
