ARM 17.50.210. MOTOR VEHICLE GRAVEYARDS

(1) Each motor vehicle graveyard must be licensed, but no fee is required. Each graveyard shall comply with the requirements of this subchapter for motor vehicle wrecking facilities. (2) County motor vehicle graveyards shall keep records for every vehicle placed in a motor vehicle graveyard. The county shall send those records to the department every quarter. The records must include: (a) make, model, year, and vehicle identification number; and (b) one of the following: (i) certificate of ownership; (ii) sheriff’s certificate of sale; (iii) notarized bill of sale from the former owner or person selling the vehicle; (iv) release of ownership or interest in the motor vehicle; or (v) sheriff’s release. (3) If a county contracts a third party to operate its free motor vehicle graveyard or to collect junk vehicles, the county must provide the department a copy of the contract. The department must approve the contract before it takes effect. The contract must require the contractor to comply with all applicable laws and rules in this subchapter. If the operator does not comply with these laws and rules, the contract becomes invalid. (4) No salvage or parts removal is allowed from vehicles that have been turned over to a county junk vehicle program. (5) The county shall publish information about how junk vehicles may be collected and accepted at each graveyard. Each motor vehicle graveyard must be supervised whenever it is open to the public. (6) The department may request reports from motor vehicle graveyards. Department staff must be allowed to visit the site, review records, and observe operations during normal business hours. (7) Junk vehicles must be placed in an orderly manner on site. Vehicles may be stacked, as long as they remain shielded from public view. (8) If a county makes major changes to how a graveyard operates, where it is located, or how vehicles are collected—compared to what is in the approved county plan—the county shall submit an updated plan to the department within six months.
