ARM 10.16.3502. TRANSFER OF PARENTAL RIGHTS AT AGE OF MAJORITY

(1) When a student with disabilities reaches the age of 18, parental rights under IDEA will transfer to the student in accordance with 34 CFR 300.517. (a) Beginning at least one year before a student’s 18th birthday, the student’s IEP must document that the student has been informed of his or her rights under part B of IDEA that will transfer to the student. (b) The parent will be provided written notice of the transfer of rights to the student at least one year before the student reaches the age of 18. (c) Both the parent and the student will receive all notices required by 34 CFR 300.504.
