ARM 17.74.358. EMERGENCY RENOVATION OPERATION ASBESTOS PROJECT PERMITS AND ORDERED DEMOLITION NOTIFICATIONS

(1) For an emergency renovation operation, as defined in 40 CFR 61.141, the owner or operator of the facility shall complete the following: (a) no later than the next working day, submit a completed emergency notification form and the fee in ARM 17.74.406; (b) in the notification form, include enough information to show that the conditions in 40 CFR 61.141, are met; and (c) within five working days after submitting the notification in (a), submit a complete asbestos project permit application under ARM 17.74.355 and any additional fees under ARM 17.74.406. (2) For an ordered demolition under 40 CFR 61.145(a)(3), the owner or operator shall: (a) submit a completed ordered demolition notification form and the fee in ARM 17.74.406; and (b) in the notification form, explain how the conditions in 40 CFR 61.145(a)(3) are met. (3) Ordered demolitions under (2) may start immediately after the notification and fee are submitted to the department.
