ARM 17.74.514. TRAINING PROVIDER CERTIFICATION

(1) A person may not provide initial or refresher training for department certification of cleanup contractors, without a current department-issued cleanup contractor training provider certificate. (2) An applicant for cleanup contractor training provider certification shall submit to the department at least 45 working days before the requested cleanup contractor training provider certification start date: (a) a completed application for cleanup contractor training provider certification, on a form provided by the department; (b) a list of proposed instructors. Each instructor is required to have a current cleanup contractor certification. Guest speakers do not need to be certified. However, their presentation must be supervised by the department-approved training provider; (c) a detailed description of course content and the amount of time allotted to each topic; (d) a description of teaching methods; (e) a final examination that is comprised of a minimum of 50 questions, with no less than 50 percent specific to this subchapter or the provisions of Title 75, chapter 10, part 13, MCA; (f) a blank example copy of the cleanup contractor certificate that will be provided to attendees who successfully complete the course and pass the examination. Each certificate must be identified with a unique number assigned by the training provider and include: (i) the cleanup contractor certification course completed; (ii) the course attendee's legal name; (iii) the date of the cleanup contractor examination; (iv) the signature of the department-approved cleanup contractor course instructor; (v) the inclusive dates of the cleanup contractor course; (vi) the name, address, and telephone number of the cleanup contractor training provider who issued the cleanup contractor certificate; (vii) the name and address of the state or agency that approved the cleanup contractor course; (viii) a statement that the person receiving the cleanup contractor certificate has completed the cleanup contractor training required for cleanup contractor certification under this subchapter; (ix) a cleanup contractor training expiration date of two years after the date upon which the person successfully completed the cleanup contractor course and passed the examination; and (x) a clear notation if the cleanup contractor course was performed in person, online, or hybrid; (g) copies of all cleanup contractor training course materials proposed for use; and (h) the fee prescribed in ARM 17.74.518. (3) Training provider certification is valid for two years from the date of issuance. (4) Upon the department's determination that an applicant for cleanup contractor training provider certification has met all the requirements for cleanup contractor training provider certification in (2), the department shall certify the cleanup contractor training provider and assign a three-digit cleanup contractor training provider certification number.
