OPINION 47-21 March 28, 1947 (OPINION) BONDS RE: Debt Limit - Municipal Water Supply Your letter of March 26, addressed to this office, has been received and contents noted. You refer to subdivision 3 of section 21-0304 of the North Dakota Revised code of 1948. This section is in conformity with Article 35 of the Amendments to the State Constitution, which, among other things, provides that any incorporated city may become indebted in any amount not exceeding four percent of the assessed value without regard to the existing indebtedness of such city, for the purpose of constructing or purchasing waterworks for furnishing a supply of water to the inhabitants of the city, or for the purpose of constructing sewers, and for no other purposes whatever. All bonds or obligations in excess of the amount of indebtedness permitted by this Constitution, given by any city, township, county, town, school district, or any other political subdivision shall be void. The project of Zeeland, therefore, would come within the provisions of subdivision 3 of section 21-0304 and Article 35 of the Amendments to the State Constitution. NELS G. JOHNSON Attorney General
