TOWNSHIPS
RE: Meetings - To be Held in Township
This office is in receipt of your letter of June 19, 1946, in which
you request our opinion as to the following questions:
1. May township meetings be held within a town in the township
or should they be held outside of the city limits?
2. May the township undertake to do road work if the labor is
not available to do the work needed?
In reply to your first question, it is my opinion that township
meetings must be held in township territory--that is territory over
which the township has jurisdiction. A township meeting may, of
course, be held within an unincorporated village. Such a village is
part of the township. But township meetings should not be held
within the limits of a city or incorporated village. If a township
does not have a township hall, meetings may, if necessary, be held in
a schoolhouse.
Replying to your second question, I beg to advise you that the matter
of doing road work rests entirely within the discretion of the
township board. If a contract is let for the performance of such
road work, it is up to the person to whom the contract is awarded to
secure the necessary labor. And if the township board undertakes to
do the work, it will, of course, have to be delayed until the
required labor can be secured.
