RE: Electrician - City Inspectors - Supervision
This is in further reply to your letter of July 17 in which you
inquire whether the state Board of Electricians could exercise
supervision over electrical work in cities having their own
inspectors.
Section 43-0921 specifying standards for electrical wiring and
equipment provides as follows:
"All electrical wiring, apparatus, or equipment shall comply
with the rules and regulations of the board, the public service
commission, the commissioner of insurance, and the state fire
marshal made under authority of the laws of this state and in
conformity with the approved methods of construction for safety
to life and property. The regulations laid down in the
national electrical code and the national electrical safety
code as approved by the American engineering standards
committee shall be prima facie evidence of such approved
methods. Any municipality may make more stringent
requirements. No electrical installation shall be connected
for use until proof has been furnished to the person, firm, or
corporation supplying electrical energy that such regulations
have been complied with."
It is, of course, obvious that inspectors appointed by the cities
must comply with the requirements of section 43-0921, supra. It
would also follow that if a question should arise as to whether or
not inspectors have complied with said statutes and the regulations
prescribed therein, it would be the duty of the State Board of
Electricians to determine whether or not the work under consideration
or inspection had been performed in accordance with the regulations
specified therein.
It is, therefore, the opinion of this office that the State Board of
Electricians has the authority under the law and may, whenever
requested, make inspection of electrical wiring or other electrical
work performed in the city to determine whether same has been
performed as required by the statutes and the regulations specified
therein.
