OPINION 49-145 November 26, 1949 (OPINION) OCCUPATIONS AND PROFESSIONS RE: Electricians - Affidavit Necessary The following question has been raised by several people and members of the board. They have asked whether or not a person, form or corporation furnishing electrical power may connect the current to electrical wiring in a building where the wiring was done several years ago and does not now comply with the rules and regulations of the State Board of Electricians, the Public Service Commission, the Commissioner of Insurance or the State Fire Marshal made under authority of the laws of this state. Section 43-0921 of the North Dakota Revised Code of 1943 provides in part as follows: "All electrical wiring, apparatus, or equipment shall comply with the rules and regulations of the board, the public service commission, the commissioner of insurance, and the state fire marshal made under authority of the laws of this state and in conformity with the approved methods of construction for safety to life and property. *** No electrical installation shall be connected for use until proof has been furnished to the person, firm, or corporation supplying electrical energy that such regulations have been complied with." This statute sets forth mandatory regulations for all electrical wiring and it does not differentiate between old and new wiring. Therefore, it is my opinion that before any firm, corporation or person can furnish or connect electrical power to electrical wiring, either old or new, they must have proof by affidavit of a person competent to make proof that there has been a compliance with such regulation.
