Under N.D.C.C. § 26.1-03-10, an insurance company shall submit an abstract of the annual statement upon a form prescribed by the commissioner. This abstract must be published at least three times in one newspaper of general circulation, designated by the commissioner, printed and published in each judicial district in this state in which the company has an agency. Proof of publication must be filed with the commissioner within four months after the filing of the annual statement. Beginning with the 2024 Annual Statement, the North Dakota Insurance Department will no longer transmit the Abstract to the North Dakota Newspaper Association (“NDNA”). Therefore, insurance companies must submit the abstract directly to the NDNA to ensure proper publication. Insurers must use the following website to submit the abstract to the NDNA via the Self-Service Portal: https://column.notion.site/submitting-notices. Proof of publication must be filed with the commissioner via OPTins or to the following email address: colicexam@nd.gov. Insurance companies must publish the abstract in the newspapers designated by the commissioner in which the company has an agency. The designated newspapers within each judicial district have the highest circulation, based on the NDNA 2024 N.D. Media Guide: East Central Judicial District: The Forum, Fargo, ND Southwest Judicial District: The Dickinson Press, Dickinson, ND Southeast Judicial District: Jamestown Sun, Jamestown, ND South Central Judicial District: The Bismarck Tribune, Bismarck, ND North Dakota Insurance Department | 2 Northeast Judicial District: The Walsh County Record, Grafton, ND Northeast Central Judicial District: Grand Forks Herald, Grand Forks, ND Northwest Judicial District: The Journal, Crosby, ND North Central Judicial District: Minot Daily News, Minot, ND Insurance companies are responsible for determining the correct judicial districts requiring publication. The counties that comprise each judicial district can be determined at https://www.ndcourts.gov/district-court. State or county mutual insurance companies shall continue to follow the applicable provisions of N.D.C.C. § 26.1-03-10. Companies with questions about uploading abstracts can email enrique@column.us.
