Cite as N.D. Admin. Code ยง 75-03-14-09
Applicants who meet the definition of identified relative, who apply to be an identified relative foster
care provider shall comply with this chapter and standards for relative licensing prescribed by the
department. The department may grant a waiver from a provision of this chapter to an applicant to
provide foster care for children if the applicant is an identified relative of a child in foster care. A waiver
may not be issued if it would result in a danger to the health and safety of any child in foster care cared
for by the child's identified relatives. The department shall prescribe the terms of the waiver. A refusal to
grant or revoke an identified relative waiver is not subject to appeal.
