The commissioner shall issue a certificate of authority for the purpose of providing health care to
Medicare enrollees only to a provider-sponsored organization that meets each requirement for the
issuance of a certificate of authority as a health maintenance organization as in North Dakota Century
Code chapter 26.1-18.1 and other applicable insurance laws and regulations of this state except when
preempted by federal law.
