50-09-08.4. Reporting arrearages to credit bureaus 1. In acting as the official agency of the state in administering the child support program under title IV-D, the state agency, directly or through agents and human service zones, subject to subsection 2, may report periodically to consumer reporting agencies the name of any obligor who owes past-due support and the amount of past-due support owed by the obligor. 2. The state agency may report under subsection 1 only after such an obligor has been provided notice and a reasonable opportunity to contest the accuracy of the statement of the name and amount of overdue support owed by the obligor. 3. For purposes of this section, "consumer reporting agency" means an agency that has furnished evidence, satisfactory to the state agency, that the agency is a consumer reporting agency as defined in section 603(f) of the Fair Credit Reporting Act [15 U.S.C. 1681a(f)].
