Nicolopoulos, Esq,CJJ DATE: March 24, 2020 RE: Title 37 P&C Signature Requirements during COVID-19 Pandemic As a result of COVID-19, the New Hampshire Insurance Department is advising all property and casualty insurers to take the appropriate precautions when obtaining Title 37 mandated signatures. Title 37's property and casualty laws do not require wet signatures. Producers and insurers are free to obtain electronic signatures. To the extent that obtaining an electronic signature is not practical considering the insurer's systems, the producer or insurer should document the need to obtain the signature and proceed to process the transaction. The Department expects that the producer or insurer will obtain the required signature after the COVID-19 situation subsides. The Department will not take regulatory action in regard to this signature issue against any producer or insurer that follows this methodology. The Department expects normal procedures to resume once the COVID-19 situation subsides.
