GOLDMAN, COMMISSIONER DEPARTMENT OF BANKING AND INSURANCE RE: ANNUAL REPORTING BY MANAGED BEHAVIORAL HEALTH CARE ORGANIZATIONS On January 20, 2006 the Department issued Bulletin No. 06-05 to provide guidance to carriers and Managed Behavioral Health Care Organizations (MBHCOs) regarding compliance with P.L. 2005, c. 172 (Act) enacted on August 5, 2005. The Act became effective on October 4, 2005, and amended and supplemented N.J.S.A. 26:2S-1 et seq. Among other things, the Act requires carriers to submit to the Department of Banking and Insurance (Department) annual reports from every MBHCO the carrier owns (in whole or in part), or with which the carrier contracts (See N.J.S.A. 26:2S- 15.1). The annual reports are to include calendar year information about payments made for behavioral health care services, total expenses incurred for certain related activities and administrative functions, the amount of fees received by the MBHCO, and the number of covered persons either under contract with the MBHCO or for whom the MBHCO provides services under contracts with carriers. Bulletin 06-05 instructed carriers to submit an Initial Report to the Department no later than March 15, 2006. The Initial Report was not intended to be a complete Annual Report because carriers would not necessarily have collected or maintained all the information required by the Act for calendar year 2005 ith the MBHCO or for whom the MBHCO provides services under contracts with carriers. Bulletin 06-05 instructed carriers to submit an Initial Report to the Department no later than March 15, 2006. Pending the Department’s promulgation of rules implementing the Act, the purpose of this Bulletin is to provide carriers with a new Annual Report form and updated information relating to filing the 2006 Annual Report with the Department. In accordance with N.J.S.A. 26:2S-15.1, carriers or their MBHCOs will be required to submit to the Department an Annual Report for calendar year 2 2006 activity no later than March 15, 2007. The Annual Report form is attached to this Bulletin. This Bulletin and a downloadable Annual Report form will be posted to the Department’s website at http://www.state.nj.us/dobi. Carriers should submit separate reports for each MBHCO they own or with which they contract during the time period covered by the report.
