Rule 1B-701 NMRA
Rule 1B-701. Transfer from probate court to district court.
If transfer is required under Rule 1B-101(B)(2) NMRA, the probate court shall
transfer the case to the district court in the county where the probate case is pending.
Whether the transfer is initiated by the probate court or on request of an interested party
or an attorney, the probate court shall make a copy of the file to retain in the probate
court and the probate court shall send the original file to the district court along with the
transfer order. Unless otherwise ordered by the court, the person initiating the transfer
shall check with the district court clerk about any fee that may be required.
