A. Prehearing procedures. Prior to determining if a hearing is warranted, the board may adopt investigative procedures to gather information needed to assist in making such a determination. B. Confidentiality. All complaints and any investigation made by the board prior to serving a notice of hearing shall be confidential. After a notice of a hearing is served pursuant to Rules 22-606 and 22-607 NMRA, the complaints and results of the investigation need not remain confidential.
