[Related Statewide Rule 1-054 NMRA] When default judgment is obtained in a case where attorney fees are recoverable by statute, court rule, or contractual agreement, the fee shall be based on the reasonable and actual time spent in obtaining the default judgment (unless the fee was predetermined by written agreement) and shall not be based on a percentage of the default judgment amount. Unless the fee had been predetermined, a fee award of one thousand five hundred dollars ($1,500.00) or more shall be by motion and order only.
