NMSA 1978, § 59A-18-33 requires the New Mexico Office of Superintendent of Insurance (“OSI”) to issue a bulletin notifying residential property insurers of any unfavorable change in a community’s public protection classification, community grading, building code effectiveness classification, or fire suppression rating schedule. Upon receiving such notice, every insurer of a residential property in the designated community shall, in turn, notify any of its customers who may be adversely impacted by the unfavorable change within 90 days of publication of a bulletin. This Bulletin serves as notice that there has been an unfavorable change to the Public Protection Classification (“PPC”) for Tucumcari, NM in Quay County. Insurance Services Office, Inc. will publish the new PPC with an effective date of October 1, 2021. Each insurer of a residential property in the identified community shall notify each customer who may be adversely affected by the unfavorable change within ninety (90) days of the publication of this bulletin. The notice issued by an insurer to a policyholder shall include the language specified in OSI Bulletin 2019-015.
