FRANCHINI, SUPERINTENDENT OF INSURANCE DATE: DECEMBER 22, 2015 RE: SUSPENSION OF BULLETIN NO. 2015-031 This Bulletin is issued pursuant to Section 59A-2-8 NMSA 1978 of the New Mexico Insurance Code, 13.1.2 et seq. NMAC. On November 13, 2015, the Superintendent issued Bulletin No. 2015-031, which related to health insurance and premium tax surcharges. Enforcement of that Bulletin No. 2015-031 is hereby SUSPENDED. This suspension specifically contemplates further study of the economic, legal, industry and consumer effects of the implementation of the terms of the Bulletin No. 2015-031 and refinement of the terms contemplated by the statute provision invoked. A task force to undertake this evaluation shall be formed immediately under the leadership of this agency, and a hearing on the issues raised will be scheduled if necessary.
