NMSA 1978, § 59A-6-1.2 provides that annual rates and forms filing fees are due in advance by July 1. In prior years, The New Mexico Office of Superintendent of Insurance (“OSI”) issued invoices to property and casualty companies, and posted those invoices on or before June 1. Recent and ongoing information technology infrastructure changes at OSI unavoidably delayed the preparation of the annual invoices for 2018. In light of those delays, property and casualty insurers have asked whether OSI will extend the deadline for paying the rates and forms filing fees. Property and casualty insurers are entitled to a reasonable amount of time to undertake and complete the activities necessary to pay OSI invoices for rates and forms filing fees. Due to the unavoidable delays in OSI’s administration of NMSA 1978, § 59A-6-1.2 , Property and Casualty Rate and Form Filing Fees owed pursuant to that statute will be deemed timely if they are paid in full, and as invoiced, on or before August 1, 2018.
