RE: DATA CALL FOR POLICY LANGUAGE, RATES, PLAN STATUS AND
ENROLLMENT
THE FOLLOWING BULLETIN is issued pursuant to NMSA 1978, §§ 59A-2-8 and 59A-4-3 and
13.1.2.8 NMAC.
A “grandfathered” plan is an individual or small group health benefits plan issued with an effective
date of March 23, 2010 or earlier that is not compliant with requirements of the Affordable Care Act.
For definitions of other terms used in this bulletin, see 13.10.29 NMAC.
All health insurance carriers offering “grandfathered” health benefits plans in the individual
and small group markets in New Mexico at the time of the issuance of this bulletin shall submit the
following data related thereto as an informational filing in SERFF by Friday, January 11, 2019:
1. All policies, certificates, riders, endorsements and other attached papers.
2. The total number of New Mexico residents covered by each such plan.
3. A breakdown by age of New Mexico residents covered by each such plan as follows:
a. Number of covered lives 18 and under.
b. Number of covered lives between the ages of 19 and 25.
c. Number of covered lives between the ages of 26 and 35.
d. Number of covered lives between the ages of 36 and 45.

e. Number of covered lives between the ages of 46 and 55.
f. Number of covered lives between the ages of 56 and 64.
g. Number of covered lives over the age of 65.
4. Rate tables for each plan as of March 22, 2010 and as of October 1, 2018, along with the dates and percentages of change for all rates utilized during the intervening years.
5. The date on which each plan's documents were last filed with OSI for review and approval for issue in New Mexico and the respective SERFF filing numbers.
