§ 9-8-7.3. Incarcerated persons; behavioral health services; county funding program

To carry out the provisions of Subsection E of Section 9-8-7.1 NMSA 1978 and to provide behavioral health services to persons who are incarcerated in a county correctional facility: A. the secretary shall adopt and promulgate rules: (1) pursuant to which a county may apply for and be awarded funding through the department; and (2) to establish priorities and guidelines for the award of funding to counties; and B. the department shall distribute funds, as funding permits, to the county health care assistance funds of those counties: (1) that apply for behavioral health services funding in accordance with department rules; and (2) whose proposed utilization of funding pursuant to this section meets the priorities and guidelines for the awarding of behavioral health services funding established in department rules.
