Bulletin Number 98-002 April 27, 1998 Filing Procedures for Property and Casualty Insurance Pursuant to the Nevada Revised Statutes and regulations adopted by the Division of Insurance, the Commissioner shall: Interpret subsection 2 of NRS 686B.030 as requiring the following filings: Policy coverage forms, endorsements, application forms and declarations pages for all business and commercial insurance. Rules, rates, policy coverage forms, endorsements, application forms and declarations pages for the following types of insurance: Dwelling, up to 4 units; Motor vehicle insurance covering private passenger vehicles; Personal surety; Bail bond; Hospital comprehensive liability; Personal inland marine; Vehicle mechanical breakdown; Insurance for home protection which is regulated pursuant to NRS 690B.100 to 690B.180, inclusive; and Insurance covering the liability of a practitioner licensed pursuant to chapters to 640, inclusive, of NRS. II. Regulate filings made pursuant to NRS 686B.070 as follows: A filing for rates/loss costs must be approved or disapproved by the Commissioner no later than 60 days after it is determined to be complete. Each filing is deemed complete upon its filing with the Commissioner, unless within 15 business days after it is filed, the Commissioner determines that the filing is incomplete because it does not contain the supporting documentation specified in NAC 686B.500 to 686B.503, inclusive, NAC 686B.715 and NAC 686B.720, as applicable. Filings for policy coverage forms, endorsements, application forms and declarations pages must be submitted to the Commissioner on or before the effective date. III. Require every insurer, rate service organization, and every group, association, or other organization of insurers which engages in joint underwriting or joint reinsurance to maintain all information necessary to support rating plans, underwriting rules, and coverage forms. The maintenance of such records by a licensed rate service organization of which an insurer is a member or subscriber will satisfy compliance with this section. Such records must be available for inspection by the Commissioner or his designee, with reasonable advance notice, pursuant to NRS 679B.230, et seq. The procedures set forth in this bulletin are in addition to, and do not replace, the procedures set forth in Bulletin 87-4, dated December 4, 1987, which remains in effect. ALICE A.
