Approval required of proposed postmining use of land.

Notwithstanding any other provisions of NAC 519A.010 to 519A.415 , inclusive, a proposed postmining use of land must be approved by: 1. If the land is subject to the jurisdiction of the Bureau of Land Management, the United States Forest Service or another federal land management agency, the federal land manager; or 2. If the land is privately owned and if required by law, a local governmental entity with the authority to approve the postmining use of private land within its jurisdiction.
