1. Within 3 years after the effective date of the permit and at least every 3 years thereafter, an operator shall review the amount of surety filed to cover the cost of reclamation to determine whether it is still adequate to execute the approved plan for reclamation taking inflation into consideration. 2. The operator shall: (a) Notify the Division, the Bureau of Land Management, the United States Forest Service and another federal land management agency, if appropriate, of the results of the review of the surety; and (b) Within 60 days after the approval of the review by the Division: (1) Request a decrease in the surety; or (2) Increase the surety, Ê to execute the plan for reclamation.
