A licensee shall not make any false or misleading communications about himself or herself or his or her services. A communication shall be deemed to be misleading if it contains: 1. A material misrepresentation of fact or law, or omits a fact necessary to make the statement, considered as a whole, not misleading; or 2. A testimonial or endorsement representing that a person is a patient of the licensee made by a person who is not in fact a patient of the licensee.
