Space occupied by other entities

(a)
Areas within a licensed hospital facility that are leased to, or
occupied by, a separate entity and comply with Health Care Occupancy
requirements as specified by NFPA 101, 2000 edition, shall be separated
from the licensed hospital by demising partitions that are rated not
less than one (1) hour fire resistance. Lease areas that do not comply
with Health care Occupancy requirements as specified by NFPA 101, 2000
edition, shall be separated from the licensed hospital by demising
partitions that are rated not less than two (2) hour fire resistance.
(b)
Lease areas shall have signage that clearly identifies tenant
areas from hospial areas.
(c)
The lease between the hospital and the tenant entity shall require
that the tenant area shall be:
(1)
Maintained to comply with NFPA 101 for Health care Occupancies;
(2)
Included in the hospital’s sprinkler systems, fire alarm
systems, and fire drills; and
(3)
Accessible to representatives of the Department to determine
compliance with these standards.
(d)
A copy of the executed lease agreement shall be submitted to the
Department for review as part of the plan approval application process
and a current copy shall be available for review by Department staff
upon request.
