OAR 414-175-0092. Legal Status of Benefits Payments

(1) The Department considers a benefit or payment issued if the check has been handed to the recipient, or mailed to the recipient. The Department considers a benefit or payment issued, and received by the individual, when a direct check deposit is made to the recipient’s bank account. (2) Benefits or payment, once issued, are unrestricted and do not require accountability for individual expenditures or amounts, unless limited elsewhere in rule.
