OAR 860-002-0000. Applicability of Division 002

(1) The rules in this division apply to a complaint filed under ORS 756.500 that is not a consumer complaint filed under OAR chapter 860 divisions 021, 034, 036, or 037 and are intended to facilitate informal resolution of disputes and to provide fair, timely, and confidential settlement of issues to reduce litigation before the Commission. (2) Upon request or its own motion, the Commission may waive any of the division 002 rules for good cause shown. (3) Upon the filing of a joint request for alternative dispute resolution (ADR), all procedural deadlines associated with any complaint that raises the same disputed facts and issues between the same parties are stayed. The stay is lifted upon the conclusion of the ADR process.
