OAR 860-036-2130. Acquisition Adjustment

(1) When seeking to acquire all or part of a water utility, the applicant may request that some or all of the difference between the net book value and the purchase price be included in the purchasing utility's rate base. (2) The Commission will consider the merits of the utility’s application based on the benefit to the customers being acquired and the public interest on a case-by-case basis.
