ANALISIS DE COSTOS Y BENEFICIOS
Las proyecciones que realizamos se basan en la solicitud de permisos (nuevos,
renovaciones, modificaciones) y otras tarifas de servicios, que podemos determinar de
forma razonable mente oierta. Debido a que las facilidades reguladas tienen que contar
con los permisos requeridos por el reglamento y de no contar con los permisos se exponen
a incumplimiento con las normas que acarrean multas y hasta el clerre.
En el Reglamento encontramos reglas como la 112 contiene prohibiciones generales y
nos es imposible proyectar posibles violaciones a estas prohibiciones que se puedan
encontrar como parte de una Inspección de cumplimiento, las Inspecciones para investigar
cualquier querella Q las Inspecciones que se realizan el proceso de aprobar un permiso
pueden incluir infracciones al Reglamento pero esas violaciones al Reglamento no
podemos realizar una proyección ya que son muy variables en un periodo del tiempo.
En las proyecciones, todas las tarifas de solicitud de permiso se incluyeron por categoría
de relleno sanitario, además, del costo de presentación tardía, SI existe un permiso vigente
que no requiere una renovación en cierto momento, se puede presentar una modificación,
estas proyeociones se incluyeron en las tablas que presentamos en las próximas páginas,
las cuales se basaron en dos (2) rellenos sanitarios por año por tipo, Esta última
presunción fue la misma para todas las proyecciones. Sin embargo, si se envía un plan
modificado cón una solicitud de renovación, no se requiere una tarifa de modificación.
Las actividades relacionadas al cumplimiento 0 la fiscalización del Reglamento serán
realizadas por el personal que ya está en el DRNA. Sin embargo, la USEPA delegó al
DRNA la implementación del Subtitulo D de RCRA y recibió fondos federales para esos
fines, como parte de la aprobación de la Subvención del Plan de Trabajo de Apoyo al
Programa Estatal de Manejo de Residuos Peligrosos para Apropiaciones Suplementarias
para el Plan de Trabajo de Ayuda en Desastres y requieren la contratación de nuevos
empleados. Sin embargo, en este caso particular, el 100% de los posibles gastos serán
cubiertos por los fondos federales y no requerirán el 25% de los fondos de contrapartida
estatales que normalmente requieren otras subvenciones federales.
Estos son los supuestos que se hacen para cada una de las proyecciones:
1. Escenario: Optimista (100% de los Sistemas de Relleno Sanitario por categoría,
solicitud de permiso de construcción de todos los que tienen la capacidad de expandirse
o necesitan celdas estabilizadas, todas las categorfas). Esto se basa en 29 Sistemas de
Rellenos Sanitarios. Consulte el texto rojo en cada tabla para identificar las condiciones
de las proyecciones.
2. Escenario: Base / Moderado (100% de la categoría Sistemas de Relleno Sanitario,
solicitudes de permisos de construcción de todas las que tienen capacidad para expandir
las Categorías II y III). Esto se basa también en los 29 Sistemas de Rellenos Sanitarios,
pero las tarifas de solicitud de permisos de construcción de proyectos solo son para los
rellenos sanitarios Tipo II y III.
3. Escenario: Pesimista (100% de la categoría Sistema de Relleno Sanitario, sin
solicitudes de permisos de construcción para expansiones O estabilización). Esto también
se basa en los 29 Sistemas de Rellenos Sanitarios, pero no proyecta ninguna solicitud de
permiso de construcción.

a. This fee varies depending on how many tons are received by the Landfill per year, as established in the current Regulation for the Management of Non-Hazardous Solid Waste (RMNHSW), which has five (5)
categories. This fee varies depending on the type of landfill, which is based upon the range of tons that receives per year, as established in the new Regulation for the Landfill Systems (RLS), which has three (3)
categories.
b. in the RMNHSW this fee corresponds to 1/2 or 50% of the Permit Fee. In the RLS the fee consist of the operational permit's fee.
C. This fee is not required in the current RMNHSW, but it is required in the new RLS. In the latter the fee consist of 1/2 or 50% of the operational permit's fee.
