A. According to the norms of the United States Department of Labor, the following criteria will be used to determine if the trainee is a student or an employee: 1. The training is similar to training offered by an educational institution, even if it entails operating within the employer's facilities. 2. The training is for the benefit of the trainee or student. 3. The trainee or student does not take the place of a regular employee, but works under a regular employee's supervision. - 3 - 4. The employer providing the training does not benefit from the activities carried out by the trainee or student, and on occasions his/her activities may be obstructed. 5. The trainee or student will not necessarily be employed upon termination of the training period. 6. The employer and the student acknowledge that the student shall not receive a salary during the period of training. B. If in compliance with the above mentioned criteria, the trainee shall be considered a student. C. Supervisores in charge of student trainees shall assure compliance with the above mentioned criteria. D. It is expressly forbidden to contract student trainees without first ensuring compliance with the procedure established in these Regulations. E. Supervised practice shall be carried out from 8:00 A.M. to 4:30 P.M., which constitutes the regular working schedule of the Agency's civilian personnel.
