These Regulations shall be in force immediately following their approval and submission to the State Department, as established by Law Number 170 of August 12, 1988, as amended, also known as "Ley de Procedimiento Administrativo Uniforme para el Estado Libre Asociado de Puerto Rico" (Law of Uniform Administrative Procedure for the Commonwealth of Puerto Rico). In San Juan, Puerto Rico Date of Approval : April 27, 1990 Date of Effectiveness : 30 days following State Department submission Police Superintendent SUPERVISED TRAINING EXPERIENCE AGREEMENT APPEARING ON THE ONE HAND: institution of higher education duly accredited by the Council on Higher Education, represented herein by its President of legal age, resident of , Puerto Rico, hereinafter called " THE FIRST PARTY " ON THE OTHER HAND: The Puerto Rico Police Department, represented in this act by , Superintendent, of legal age, married and resident of Puerto Rico, hereinafter called "The Second Party ". Having the appearing parties the legal capacity to award this Agreement, they mutually agree to carry it out subject to the following: CLAUSES AND CONDITIONS FIRST: "THE SECOND PARTY" shall admit in its facilities students that are studying in "THE FIRST PARTY" to obtain a degree in , for the purpose of obtaining a practical experience in academic areas related to their academic majors through the non-participating observation of tasks and procedures carried out by "THE SECOND PARTY". SECOND: Both parties agree that the practical experience of student trainees shall pursue the attainment of those objectives established in the supervised training course compendium of "THE FIRST PARTY". THIRD: Both parties shall select by mutual agreement the centers where student shall benefit from training. To this effect, "THE FIRST PARTY" shall submit to "THE SECOND PARTY", no later than five (5) days prior to the date of commencement of the training experience, a list of students to be assigned to each Training Center together with all forms duly complemented. "THE SECOND PARTY" shall send to "THE FIRST PARTY" sufficiently in advance a list of all Training Centers available to serve as practice laboratories, which shall have to meet the following conditions: - 2 - a. That installations destined to such purposes shall be of such nature that the student will clearly perceive that he or she is training in a work environment; that Center personnel is not being substituted, and that participation does not entail the expectation of a future employment in the Center. b. That it shall facilitate the attainment of the objectives of the academic institution's Supervised Training Program and constitute an adequate medium in which the student can integrate the theoretical knowledge obtained. FOURTH: "THE SECOND PARTY" shall determine the number of students to be admitted at each of the Training Centers to obtain a practical experience. FIFTH: "THE FIRST PARTY" shall be responsible of selecting students that meet the requirements established by "THE SECOND PARTY". SIXTH: "THE SECOND PARTY" reserves the right to request from "THE FIRST PARTY" the termination of any student who, bases on the judgement of the Training Center Director, requires immediate separation due to violations of the norms established at the Training Center. SEVENTH: "THE SECOND PARTY" or its authorized representative shall designate a Coordinator or Supervisor at the Training Center who will act as determined to ensure compliance with the present Agreement. EIGHTH: "THE FIRST PARTY" shall designate a Training Coordinator or Supervisor who will provide orientation to students on relevant matters to assure compliance with the purpose of this Agreement. NINTH: BOTH PARTIES shall inform all students selected to participate in the training experience about the norms governing each Training Center, including specifically laws and regulations established by the Federal Government and the government of Puerto Rico on the confidentiality of reports and records related to clients of "THE SECOND PARTY", and also norms governing their training. - 3 - TENTH: "THE FIRST PARTY" shall produce and provide all materials needed for the planning, development and evaluation of student practice. ELEVENTH: Students of "THE FIRST PARTY" shall be advised of the confidentiality of matters they may learn of while engaged in their supervised training. Furthermore, they shall be warned that they are forbidden to reveal to third parties matters they may learn of as part of their supervised training, during or after the training is finished, and that they shall not take out or reproduce any document they may have access to at the Training Center. Any violation to this Clause of the Agreement shall result in the student of "THE FIRST PARTY" being summarily terminated from training. TWELFTH: "THE FIRST PARTY" shall be responsible of any claim against "THE SECOND PARTY" arising as a consequence of acts or omissions of student trainees. THIRTEENTH: "THE FIRST PARTY" shall acquire insurance against any damages suffered by students at the Training Centers of "THE SECOND PARTY". A copy of the insurance policy shall be provided to "THE SECOND PARTY" PREVIOUS TO THE SIGNING OF THIS AGREEMENT. FOURTEENTH: BOTH PARTIES hereby note their agreement that student trainees are not and shall not be considered employees of "THE SECOND PARTY", NOR SHALL THEY ACQUIRE by virtue of this Agreement any rights as such, nor receive any type of payment from "THE SECOND PARTY" for services rendered at the Training Centers. FIFTEENTH: BOTH PARTIES shall maintain periodic communication, programming and coordination, during and at the end of the program, to attain integration and discuss matters pertaining to the training program, and make adjustments according to the needs of both parties and subject to the clauses and conditions of this Agreement. - 4 - SIXTEENTH: This Agreement shall become effective on the date it is granted and extend over the period of academic year 199 - 1999 , unless any of the parties shall decide to terminate it, in which case, the party wishing to rescind shall notify the other PARTY of its intention no less than thirty (30) days previous to the date of rescission.
