A. Federal Roles and Responsibilities 1. NOAA will, subject to appropriation, provide funding pursuant to 15 CFR Part 921, on a matching basis, for continuing operation, management, and construction, dependent upon the availability of Federal funds and upon the results of the periodic evaluation made pursuant to Sections 312 and 315 of the C2MA. 2. NOAA recognizes that the disbursement of all Federal funds by the DEPARTMENT will conform to established budgetary and administrative procedures of Federal regulations and OMB circulars. 3. NOAA will hold the Commonwealth and DEPARTMENT responsible for conformance with the purposes of JOBANERR, as specified in Article I. 4. NOAA will make periodic evaluations of the progress achieved by the DEPARTMENT in operating and managing JOBANERR, pursuant to Sections 312 and 315 of the CZMA. 5. NOAA acknowledges that JOBANERR staff are subject to the regulations, rules, and procedures of the DEPARTMENT under the direction of their supervisor. 6. If appropriate, NOAA will support the budget requests of the DEPARTMENT to the Legislative Assembly for staff and funds, or other resources needed for the proper operation and management of JOBANERR. 7. NOAA will provide advice and information to the DEPARTMENT related to environmental issues affecting the PROGRAM, including but not limited to, review and comments on environmental impact statements, and use proposals, research sponsorship and the development of educational materials. 8. NOAA will assist the DEPARTMENT in seeking coordination and cooperation with other Federal agencies to enhance the JOBANERR programs, as appropriate. 9. NOAA acknowledges that JOBANERR staff will directly manage all the lands within the Reserve, and that the implementation of the Management Plan may involve the participation and coordination with other staff of the DEPARTMENT and Memoranda of Understanding with other agencies, as appropriate. 217 B. Commonwealth Roles and Responsibilities 1. The DEPARTMENT, as the recipient of Federal funds, will be solely responsible for ensuring that the operation and management of JOBANERR conforms to the purposes of JOBANERR, as specified in Article I. 2. The DEPARTMENT will solicit appropriate budgetary support for the continuing operation and management of JOBANERR for the continuing operation and management of JOBANERR from the Legislative Assembly. 3. The DEPARTMENT will operate and manage JOBANERR in accordance with implementing regulations of Section 318 of the C2MA. 4. The DEPARTMENT will provide NOAA with performance reports as required by special award conditions in grant awards to the DEPARTMENT and with an annual performance report thereafter. The performance reports will include summaries of recent activities related to the operation and management of JOBANERR and its resources, as well as the education and research programs related to it.
