EVALUATIONS

A. NOAA will evaluate the progress of the DEPARTMENT in operating and managing JOBANERR, pursuant to Sections 312 and 315 of the CZMA, on periodic basis. If NOAA finds, through such an evaluation, that the DEPARTMENT is not operating and managing JOBANERR in a manner consistent with the PROGRAM Mission and Goals, is not attaining the Objectives as set forth in Article I, or that any other basis for interim sanctions or withdrawal of designation exists under the implementing regulations of Section 315 of CZMA, NOAA will notify the DEPARTMENT and will attempt to resolve the issue through the procedure set forth in CZMA implementing regulations. B. The DEPARTMENT will evaluate annually the status of the operations and management of JOBANERR and the effectiveness of Federal/Commonwealth cooperative effort. The findings will be included in the annual performance report to NOAA. All problems identified by the DEPARTMENT as related to consistency with the PROGRAM Mission and Goals or attainment of the Objectives will be discussed with NOAA so as to arrive at mutually agreeable solutions. 218
