MASTER MEMORANDUM OF UNDERSTANDING
Dated October 27, 1981
THIS MEMORANDUM OF UNDERSTANDING made and entered into by and
between the Department of Natural Resources of the Commonwealth
of Puerto Rico, under authority of Law No. 23 of June 20, 1972,
Law No. 13 of July 1, 1975, and Law No. 70 of May 30, 1976, and
the Southern Forest Experiment Station and Region 8 of the Forest
Service, U.S. Department of Agriculture, under authority of 16
U.S.C. 1641-1646, hereinafter referred to as the Department and
the Forest Service, respectively, witnesseth:
WHEREAS, the Department is responsible for the administration and
management of forest resources under the jurisdiction of the
Commonwealth of Puerto Rico, and
WHEREAS, the Department has been and is currently engaged in the
scientific study of forests in Puerto Rico, and
WHEREAS , the Department has interest in continuing ecological
research in the forests of Puerto Rico, and
WHEREAS, the Forest Service is responsible for the administration
of the Caribbean National Forest, and
WHEREAS, one of the objectives of the Forest Service through the
Southern Forest Experiment Station in Puerto Rico is to generate
new knowledge about tropical forests through research, and
WHEREAS, the parties hereto are mutually interested in furthering
studies leading to the better understanding of the structure and
function of forest resources in Puerto Rico.
NON THEREFORE, in consideration of the above premises and in the
interest of mutual advantage in attainment of common objectives,
the parties hereto desire to cooperate and mutually agree as
follows:
1, To consider jointly at such places and at such intervals as
may be currently agreed upon by the parties hereto a general
program of research.
2. To jointly develop specific agreements and plans of study for
individual studies considered by the parties hereto to be of
mutual interest.

3. To develop and facilitate plans for publication and
dissemination of research results obtained by the parties hereto,
which in the judgment of all parties can be handled most
advantageously by joint effort.
1. To enter into mutually agremable working arrangements as
occasion demands for the use of experimental forests,
laboratories, buildings, equipment and other facilities owned and
operated by either party hereto for special work in forestry
research and extension.
5. Utilize cooperation to transfer expertise from specialists to
trainees either of which may represent any of the parties.
6. To develop working plans as the occasion demands for
collecting materials within the experiment forest hereto to be
used for research by either party.
7. To jointly participate in the design of educational programs
to be conducted by either party.
8. To share information and expertise related to the
objectives-and strategies for the scientific management of
experimental or natural forests.
9. Nothing herein shall be construed as obligating the Forest
Service or the Department to expend, or as involving the United
States or P.R. in my contract or other obligation for the future
payment of money in excess of appropriations authorized by law.
No member of, or Delegate to, Congress, or Resident Commissioner,
shall he admitted to any share or part of this Memorandum or to
any benefit to arise therefrom, but this provision shall not be
construed to extend to this Memorandum if made with a corporation
for its general benefit.
In performance of the terms of this agreement no convict labor
shall be used, and the parties shall comply with the provisions
of the Work Hours Standards Act of 1962, Public Law 87-581 (40
U.S.C. 328) as to the employment of laborers and mechanics.
Work under this agreement will be determined by specific supplemental agreements entered into under authority of this
instrument.
This Memorandum of Understanding may be amended by mutual consent
of all parties hereto and may be terminated by any party
providing 60 days' written notice. Unless terminated by written
notice, this Memorandum shall remain in force indefinitely.

UNIVERSIDAD DE PUERTO RICO
E1 proposito de este Acuerdo Cooperativo entre el Programa de
Colegio Sea Grant de la Universidad de Puerto Rico (de aquí en
adelante "Sea Grant") y el Departamento de Recursos Naturales y
Ambientales (de aquí en adelante "El Departamento") es colaborar
en los aspectos de desarrollo y producción de material educativo
y
otros aspectos relacionados con la educación sobre la Reserva
Nacional de Investigación Estuarina de Bahia de Jobos (JBNERR de
sus siglas en inglés).
Como parte del Acuerdo Cooperativo, las partes acuerdan como
sigue:
1. Sea Grant realizará las siguientes tareas:
a. Previo acuerdo con "El Departamento", "Sea Grant",
aportará fondos, proveerá los recursos de artes gráficas,
edición, publicación y otros, de ser necesario, para la
producción de material educativo relacionado con los
recursos estuarinos del JBNERR.
b. Previo acuerdo con "El Departamento", "Sea Grant"
mantendrá una cuenta especial Sea Grant/Departamento
(JBNERR), en la cual se ingresará el dinero obtenido por
concepto de la venta de materiales impresos mediante este
acuerdo.
C. Administrará los fondos provistos por "El Departamento"
(JBNERR) y velará por su buen uso. "Sea Grant" no
incurrirá en gastos adicionales a los previamente
acordados. "Sea Grant" mantendrá los archivos
financieros sobre estos fondos y éstos podrán ser
auditados, de ser necesario, por el Gobierno Federal 0 el
Departamento. En adición, preparará y someterá
al"Departamento" informes financieros sobre el uso de los
fondos, en abril y septiembre (informe anual) del año que
corresponda.

d. Previo acuerdo con "E1 Departamento", "Sea Grant"
colaborará en el desarrollo de actividades educativas para
el mejoramiento profesional de maestros del sistema escolar
de Puerto Rico, al igual que otras dirigidas al publico en
general relacionados con los recursos estuarinos de JBNERR.
2. "E1 Departamento", a través de su Programa JBNERR proveerá:
a. Ayuda y asesoramiento a "Sea Grant" cuando esta sea
requerida por el representante del mismo y sujeto a la
disponibilidad de personal y fondos de JBNERR.
b. "E1 Departamento" aportará fondos para las tareas de
producción de material educativo sobre recursos estuarinos,
a ser transferidos a "Sea Grant", según sea necesario y
previo acuerdo entre las partes.
3. Ambas partes acuerdan como sigue:
a. E1 Dr. Manuel Hernández-Avila, Director del Programa de
Colegio Sea Grant y Profesor del Departamento de Ciencias
Marinas del Recinto Universitario de Mayaguez, será el
representante de "Sea Grant":
b. E1 Secretario del Departamento de Recursos Naturales y
Ambientales, Hon. Pedro A. Gelabert, representará al
Departamento y la Sia. Carmen M. González, Directora de la
JBNERR, fungirá como Coordinadora de Enlace con Gl Programa
Sea Grant.
C. Ambos programas colaboran en el desarrollo de actividades
educativas pare el mejoramiento profesional de maestros del
sistema escolar de Puerto Rico, al igual que otras
dirigidas al público en general relacionados con los
recursos estuarinos.
d. Ninguna de las partes tomará acción legal alguna contra
la otra parte por daño accidental ocurrido a personal del
Departamento © Sea Grant durante el desempeño de las labores
pertinentes a este Acuerdo.
e. Las publicaciones y otros materiales producidos por medio
de este acuerdo llevarán los logotipos de las instituciones
participantes; en este caso del Programa de Colegio Sea
Grant, el DRNA y la Reserva Estuarina de Bahia de Jobos.
£. Este Acuerdo podrá ser modificado por mutuo acuerdo de
ambas partes en cualquier momento.

g. Este Acuerdo podrá ser anulado por cualquiera de las dos
partes mediante comunicación escrita al respecto, por 10
menos con noventa (90) días de anticipación.
h. Este Acuerdo será renovado cada primero de octubre sin
necesidad de mediar comunicación escrita al respecto.
1. Este Acuerdo entrará en vigencia desde La fecha de su
firma por el Oltimo firmante.

ACUERDO COOPERATIVO PARA LA COLABORACION ENTRE EL
DEPARTAMENTO DE RECURSOS NATURALES Y AMBIENTALES
(RESERVA NACIONAL DE INVESTIGACION ESTUARINA DE BAHIA
DE JOBOS) Y EL INSTITUTO DE INVESTIGACIONES SOBRE
RECURSOS DE AGUA DE PUERTO RICO
El propósito de este Acuerdo Cooperativo entre el Instituto de
Investigacion de Recursos de Recursos de agua (de aqui en
adelante el "Instituto") y el Departamento de Recursos Naturales
y Ambientales (de aqui en adelante el " Departamento") es
colaborar en el desarrollo, manejo y otros aspectos relacionados
con la investigación y educación sobre ,la Reserva Nacional de
Investigación Estuarina de Bahia de Jobos (JBNERR de sus siglas
en inglés).
Como parte de este Acuerdo Cooperativo, las partes acuerdan como
sigue;
1. El "Instituto 14 realizará las siguientes tareas;.
a) Previo acuerdo con el Departamento, el" Instituto"
facilitará y coordinará estudios que conducirán a un mejor
entendimiento de los sistemas estuarinos.
b) Previo acuerdo con el Departamento, el "Instituto If
realizará estudios diseñados a suplir información a el
gobierno estatal y municipal y a otras entidades interesadas
en el mejoramiento del manejo apropiado de los recursos de
la cuenca y sus áreas costeras.
c) Previo acuerdo con el "Departamento", el "Instituto "
diseñará e implementará un programa de investigación
cientifica que evaluará asuntos relacionados al manejo de la
cuenca, sus recursos, y los procesos fundamentales naturales
e inducidos por actividades humanas tales como construcción,
industrialización y actividades agricolas.
d) Previo acuerdo con el "Departamento", el "Instituto"
coordinará actividades para realizar trabajos conducentes a
establecer los limites geograficos e hidrológicos de la
cuenca.
e) Previo acuerdo con el "Departamento", el "Instituto"
mantendrá una cuenta especial de investigacion en la cual se
ingresará el dinero transferido al "Instituto" por concepto
de los acuerdos estipulados.
f) El " Instituto" administrará los fondos provistos por el
.. Departamento" (JBNERR) y velará por su buen uso. El

"Instituto" no incurrirá en gastos adicionales a los
previamente acordados. El "Instituto" mantendrá los archivos
financieros sobre estos fondos y éstos podrán ser auditados,
de ser necesario, por el gobierno Federal 0 el 19
Departamento". En adición, preparará y someterá al
"Departamento" informes financieros sobre el uso de los
fondos anualmente.
2. El "Departamento", a través de su programa JBNERR proveerá:
a) Ayuda y asesoramiento al "Instituto" cuando sea requerido
por el representante del mismo y sujeto a la disponibilidad
de personal y fondos de JBNERR.
b) El "Departamento" aportará fondos pare las tareas
descritas en el inciso numero 1 a ser transferidos al
"Instituto", según sea necesario y previo acuerdo entre las
partes.
3. Ambas partes acuerdan como sigue:
a) E1 Director del Instituto de Investigaciones sobre
Recursos de Agua de Puerto Rico será el representante
del "Instituto".
b) El Secretario del Departamento de Recursos Naturales
y Ambientales, representará al "Departamento" y el
Director de JENERR fungirá como coordinador (a) de
enlace con el "Instituto".
c) Ambas instituciones colaborarán en la elaboración y
desarollo de investigaciones dentro de la cuenca que
compone la Bahia de Jobos
d) Ninguna de las partes tomará acción legal contra la
otra parte por daño accidental ocurrido a personal del
Departamento O del Instituto durante el desempeño de
las labores pertinentes a este Acuerdo.
e) Este Acuerdo podrá ser modificado por mutuo acuerdo
de ambas partes en cualquier momento.
f) Este Acuerdo podrá ser anulado por cualquiera de las
dos partes mediante comunicación escrita al respecto,

APENDICE I: LA LABOR DEL CUERPO DE VIGILANTES DE VIGILANCIA Y DE VELAR POR EL
CUMPLIMIENTO DE LA LEY
El cuerpo de vigilantes se créó en virtud de la Ley Número uno del 19 de junio de 1977. Su misión es hace
cumplir las leyes y regulaciones del Departamento de Recursos Naturales y Ambientales (DRNA). Esta Ley
también da poderes a los vigilantes para que pueda hace cumplir todas las leyes y regulaciones del Estado Libre
Asociado de Puerto Rico relacionadas con la conservación y el desarrollo de sus recursos naturales (ver pagina
175 para las autoridades especificas). El Organigrama de el Cuerpo de Vigilantes se encuentra en la página 58.
Al presente, el Cuerpo de Vigilantes del DRNA consiste de vigilantes y oficina con la Oficina Central en San
Juan. Hay 7 Oficinas Regionales en San Juan, Arecibo, Mayagüez, Aguadilla, Ponce, Guayama y Humacao. En
adición, existen 27 destacamentos distribuidos alrededor de la Isla. De estos, 13 son destacamentos costeros /
marinos localizados en Piñones, Arecibo, Aguadilla, Boquerón La Parguera, Guanica, Ponce, Guayama (Puente
de Jobos), Fajardo Viequez, Culebra, Isla de Mona y Caja de Muertos.
Actualmente, hay 23 vigilantes asignados a la Región Sureste (Guayama), en donde esta localizada JOBANERR.
Este personal consiste de un oficial, un sargento y 21 vigilantes regulares. Tienen diez (10) vehículos de
patrullaje, dos (2) motoras, un bote de patrullaje y un jet ski. Recursos adicionales están disponible según sea
necesario en la Región del Sur (Ponce). Patrullajes aéreos también son posibles desde dos aviones del DRNA
estacionados en San Juan.
Patrullaje preventivo se conduce de 0600 a 2200 horas siete (7) días de la semana. Existen dos turnos por día. El
oficial a cargo determina las prioridades de patrullaje basado en la altas incidencia de violaciones. Hay dos (2)
vigilantes asignados exclusivamente a JOBANERR. Sus áreas de patrullaje son determinadas de recomendaciones
hechas por la Directora de la Reserva. Sus patrullajes son hechos en vehículos y cubren el perímetro de la
Reserva, con énfasis a los sectores de Las Mareas, Mar Negro y Camino del Indio, en donde se han detectado
construcciones y rellenos no autorizados. Patrullaje Marino en bote se lleva acabo de 0600 a 2200 horas durante
la semana. Durante los fines de semana y durante los meses de verano todo el personal disponible es asignado a
un turno, de 1000 a 1800 o de 1100 a 1900 horas dependiendo del nivel de las actividades costeras. Patrullaje
marino también se determina basado en áreas de alta incidencia de violaciones así como por el alto nivel de uso
del área. Patrullajes prioritarios en la Bahía de Jobos incluyen a Cayos Caribe, Cayos la Barca, Punta Colchones y
las agua interiores de JOBANER Mar Negro).
En adición a los deberes y autoridades legales envestidas sobre el Cuerpo de Vigilantes descritas en la pagina 175,
los vigilantes también atienden querellas hechas por ciudadanos preocupados. El siguiente procedimiento ha sido
establecido:

APÉNDICE J: PLAN DE MANEJO AREAS DE PLANIFICACION ESPECIAL DE JOBOS
Durante el año de programa anterior, se completó el trabajo para todas las Areas de Planificación Especial Si
bien se adelantó grandemente la recopilación y análisis de la información técnica disponible para la consideración
del Task Force Interagencial, el Area de Planificación Especial de Jobos necesita más trabajo por razón de las
circunstancias especiales que son únicas de esta área.
Dada la complejidad de los asuntos, las implicaciones en materia de políticas y el número de agencias y
jurisdicciones involucradas, Jobos se presta en forma ideal al uso de metodología de resolución de conflictos y al
desarrollo de consenso en torno a políticas en un área donde existen intereses encontrados que atañen tanto a
agencias del Estado Libre Asociado como federales y a los gobiernos locales.
El Area de Planificación Especial de Jobos también representa una oportunidad única para el DRNA y en
particular para la División de Manejo Costero, para desempeñar un papel de liderazgo facilitando el consenso
interagencial/intergubernamental con respecto del manejo de recursos costeros.
DESCRIPCIÓN
La situación de Jobos ofrece una oportunidad para el DNRA/OMC para desempeñar un papel de liderazgo
facilitando el desarrollo de un consenso coherente y unificado en torno a las políticas para el futuro del APE de
Jobos. El núcleo de un Task Force para el Área de Planificación Especial de Jobos ya se ha formado a base de las
deliberaciones y de las reuniones que se han llevado a cabo y que se siguen llevando a cabo entre la EPA, COE,
NOAA, la AUTORIDAD DE TIERRAS y el DNRA/JOBANERR. Entre los principales asuntos y áreas de
conflicto que es necesario resolver para el APE de Jobos se encuentran las siguientes:
1.
Contaminación de fuentes dispersas
a.
Agricultura
La agricultura es un uso predominante en la cuenca hidrográfica del Área de Planificación Especial. El
uso de abono químico y de plaguicidas podría impactar los hábitats sensibles mediante la escorrentía y la
filtración al agua subterránea.
b.
Relleno sanitario
La disposición de desperdicios sólidos es un problema creciente sin resolver. El Municipio de Aguirre ya
tiene un vertedero contiguo a los límites de la Reserva de Jobos. El vertedero procesa desperdicios
sólidos de Salinas, Coamo, Santa Isabel y otros municipios. Además, hay un vertedero tóxico en la
colindancia oriental de la Reserva de Jobos, contiguo a la Planta Termoeléctrica de Aguirre. Hace poco
se ha anunciado que se ha de establecer un vertedero dentro de la cuenca hidrográfica del APE para
procesar desperdicios sólidos de San Juan y del área metropolitana. La filtración de lixiviados representa

una amenaza de contaminación para el acuífero aluvial de poca profundidad que el único suministro de
agua dulce para la comunidad de Aguirre.
C.
Alcantarillados
No existen instalaciones de tratamiento de aguas usadas en ninguna de las comunidades contiguas a la
Reserva. Las aguas usadas crudas y el drenaje de pozos sépticos viejos y de diseño deficiente, fluyen
directamente a la Bahía de Jobos y a través del sistema de drenaje pluvial. Como resultado de la
degradación de la calidad del agua, los hábitats de la Reserva, en particular los arrecifes de coral, han
sufrido impactos serios. Al mismo tiempo, la población sigue creciendo y el área es cada vez más
atractiva para operadores de embarcaciones recreativas y vacacionistas de los centros urbanos costeros
del norte y del sur, empeorando lo que ya es un problema serio.
d.
Escorrentía urbana
El desarrollo urbano, en particular la vivienda, está aumentando rápidamente en la vecindad de la Bahía
de Jobos. Las superficies pavimentadas y las alcantarillas pluviales son medios comunes de
transportación de contaminantes dispersos. Nutrientes, aceite, grasa, solventes, detergentes domésticos,
fertilizantes, desperdicios sólidos, sedimentos y muchos otros materiales llegan sin tratar a la Bahía.
e.
Recreación
Las nuevas autopistas y vías de acceso y el aumento en los proyectos de vivienda en los municipios de
Salinas a Guayama, están comenzando a generar una demanda para el uso recreativo de la Bahía de
Jobos y de la Reserva. El aumento en la navegación recreativa y en el desarrollo de segundos hogares ya
está impactando hábitats sensibles a través de fuentes dispersas y la disposición de desperdicios sólidos y
líquidos.
2.
Agua subterránea
El agotamiento del recurso de agua potable disponible del acuífero de la costa sur por el bombeo
excesivo puede producir la intrusión de agua salada. La contaminación por filtración también representa
una amenaza seria al suministro y a la calidad del agua en general.
3.
Conflictos en el uso de terrenos
a.
Construcción y desarrollo ilegal
La construcción ilegal de viviendas para vacacionar o pasar fines de semana en la zona marítimoterrestre y a lo largo de los límites de la Reserva constituye un problema inmediato que necesita atención.
La construcción ilegal de muelles en el área de Mar Negro de la Reserva es también un problema que va
en aumento. Se han destruido grandes extensiones de hábitat de humedales como consecuencia de
actividades de relleno y de obstrucción del movimiento del agua.

b.
Desarrollo urbano e industrial
Con la desaparición del cultivo de la caña de azúcar una cantidad considerable de tierra está ahora
disponible para desarrollo particularmente en los terrrenos contiguos a la Reserva. La actividad
promocional local se ha visto fomentada por legislación que permite a los municipios desarrollar sus
propios planes de zonificación y uso de tierras aunque los mismos necesitan aprobación de la Junta de
Planificación. Todo parece indicar que habrá conflictos sobre el uso potencial de terrenos entre la
Reserva y los intereses de desarrollo municipales. Dichos conflictos deben resolverse dentro de un
contexto amplio que incluya toda el área y en el cual los intereses regionales se tengan que tomar en
cuenta al tomar decisiones a nivel local. El proceso de planificación de Areas de Planificación Especial
(APE) se presta para resolver este tipo de conflictos.
Estos desarrollos y tendencias ya han generado conflictos entre las agencias públicas a nivel estatal y federal.
Hay, además, conflictos incipientes que ya han empezado a surgir entre agencias del Estado Libre Asociado.
Σ La EPA, con el respaldo de COE, NOAA/SRD y EWS ha incoado una acción contra la Autoridad de Tierras
por el relleno ilícito de humedales en el área de Mar Negro. Esta área se encuentra dentro de la Reserva
Nacional de Investigación Estuarina de la Bahía de Jobos (JOBANERR), una de 21 reservas parecidas en
todos los Estados Unidos y, que junto con Rookery Bay en el estado de Florida, es un ejemplo sobresaliente
del entorno estuarino de las Indias Occidentales.
Σ EL DRNA, dueño y administrador de JOBANERR, como parte de un sistema nacional de estuarios, ha
endosado una Orden de Consentimiento expedida por la EPA que requiere la mitigación de los humedales
por parte de la Autoridad de Tierras.
Σ
Además de la destrucción de humedales como consecuencia de los diques y el relleno por parte de la
Autoridad de Tierras, las agencias del Estado Libre Asociado están suministrando servicios de
infraestructura (agua y electricidad) a las viviendas de construcción ilícita en Mar negro. Dada la falta de
certeza de los límites, un buen número de estas estructuras podrían estar construidas en terreno público,
posiblemente en humedales rellenados en forma ilícita. Estas viviendas construidas sin permisos de las
autoridades pertinentes probablemente violan el reglamento de la zona marítimo-terrestre.
Σ
La Junta de Planificación tiene bajo su consideración actualmente planes territoriales locales. Estos planes
contienen propuestas para el desarrollo de terrenos que podrían afectar seriamente la base de recursos
naturales de JOBANERR. No existe certeza de que la Junta de Planificación tenga pleno conocimiento de los
impactos adversos de las propuestas de planes para este entorno estuarino único.
Σ
En años recientes, se han aprobado contiguos a la Reserva de la Bahía de Jobos urbanizaciones y proyectos
industriales que también contribuyen a agotar los suministros limitados de agua subterránea y a alterar la
hidrología del agua superficial.
Todos estos desarrollos están ocurriendo de manera no coordinada. Existe una necesidad apremiante de establecer
un consenso, entre las agencias federales y del Estado Libre Asociado así como los gobiernos locales que
participan, en cuanto a las políticas para el futuro de esta área en gran medida virgen. Sin este método coordinado,

la integridad futura de la Reserva de Jobos corre peligro y el DRNA podría confrontar una situación similar a la
que existe en la Parguera.
ACTIVIDADES Y PRODUCTOS
Al momento ninguna agencia del Estado Libre Asociado está ejerciendo responsabilidad principal para confrontar
los numerosos conflictos de manejo de recursos y uso de terrenos. El recientemente convocado Task Force
Interagencial para el APE debe continuarse para el área de Jobos a fin de resolver por completo los conflictos
continuados sobre políticas y llegar a una posición de consenso con respecto al futuro de esta área. Estas
decisiones cobran importancia particular para la protección de la Reserva de Investigación Estuarina de Jobos. Por
tanto, se trabajará para seguir ayudando al Task Force a lograr la solución de los asuntos pendientes. Los
productos previstos son:
1.
Programación detallada del trabajo octubre de 1996
Esto se hará en consulta con las agencias participantes y los miembros del Task Force.
2.
Informes técnicos y análisis desde diciembre hasta agosto de 1997
Se recopilarán los datos y los informes técnicos; se prepararán mapas usando el programa GIS
de la División.
3.
Refinar la formulación de las políticas para el Área de Planificación Especial y los instrumentos para su
implementación hasta septiembre de 1998.
La exposición de las políticas que reflejan la posición de consenso del Task Force; los
instrumentos interagenciales de implementación que obligan a las agencias participantes. Los
mismos serán firmados por los directores de agencias y/o funcionarios públicos de rango con la
autoridad legal para obligar a sus organizaciones a un curso de acción específico.

1) Consent Order Status -
Consent order is with PRLA; to be signed this week or next.
2) Dike Removal -
We discussed whether or not &e material is suitable as backfill for the ditches. It was
concluded that it is not the best material, but could be used. If used to fill the ditches, it should
be covered with a layer of clay from on-site. (Subsequently, in the field, we observed that there
is more than sufficient suitable clay material in the fill roads to be used as backfill for the
ditches. No use of the dike material as backfill should be necessary.) A. Ramos stated that
PRLA may attempt to sell the dike material, but will give it away if a buyer cannot be found.
He said that PRLA will first offer the material to neighboring BFI Landfill for use as landfill
cover material. If BFI accepts it, the dike would be removed by BFI using BFI's own
equipment with PRLA supervision. Equipment necessary would be at least one front-end
loader and one dump truck.
3) Ditch Back-filling and Roadway Removals
We discussed this matter on-site, in the field. Equipment necessary will be at least one backhoe
and one front end loader. Work will commence at the seaward end of each ditch/roadway and
move backwards towards the open fields. A backhoe will be used to reach across to the far side
of each ditch and scrape or drag piles of dirt back into the ditch A front-end loader will be used
to scrape or push road material and debris into the

I. STA'lulORY AUTHORITY

The following Findings are made and Order issued pursuant
to $309 (a) of the Clean Water Act ("the Act"), 33 U.S.C.$1319 (a),
under authority vested in the Administrator of theUnited States
Environmental Protection Agency ("EPA") by the Pro. Act, and by her duly
delegated to the Regional Administrator of EPA, Region II, who has
further redelegated this authority to the Director of the Division of
Environmental Planning and Protection of EPA, Region II.
- II. STIPULATIONS AND FINDINGS
1. The Puerto Rico Land Authority ("Respondent") is the owner of a
former sugarcane estate named Hacienda Aguirre located south of
Ponce-Guayama Road, west of the Puerto Rico Electric and Power
Authority' n Aguirre Thermoelectric Power Plant, north of the
Jobos Bay National Estuarine Research Reserve, and east of the Las
Mareas community, at 17°57'30" north latitude and 66°15'00" west
longitude, in Aguirre Ward, Municipality of Salinas, Puerto Rico
(see Exhibit A).
2. The Puerto Rico Land Authority is a division of the Puerto Rico
Department of Agriculture t"the PRDA").
3. The Puerto Rico Department of Natural and Environmental Resources
("DNER") in the owner of property adjacent to, and south of,
Hacienda Aguirre, which consists predominantly of mangrove forest
(the Mar Negro Mangrove Swamp), and has been designated by
the National Oceanic and Atmospheric Administration of the
U.S. Department of Commerce, as the Jobos Bay National
Estuarine Research Reserve ("the JBNERR"), an area
established for long-term protection of estuarine
resources for the purpose of providing opportunities for

long-term research, education, and interpretation (see
Exhibit A).
4. The boundary between Hacienda Aguirre and the JBNERR is not
physically marked. It follows approximately the northern
edge of the mangrove forest.
5. Beginning in 1993, Respondent physically prepared the land
at Hacienda Aguirre for an agricultural research project
to be conducted by a lessee, Lippy Brothers, Inc., the
primary purpose of which is to attempt the farming of corn
in Puerto Rico.
6. In physically preparing the land, Respondent conducted the
following activities in an area consisting of the -
southernmost portion of Hacienda Aguirre and the
northernmost portion of the JBNERR ("the Site") :
a) Rebuilding and-widening of the southern outer dike of an
abandoned wastewater disposal area of the former, Aguirre
Sugar Mill, located at the east end of the Site, for the
purpose of constructing a roadway (see Exhibit A).
b) Side-casting of excavated soils, spreading of soils and
vegetative debris, and/or discharging of fill in areas
adjacent to and/or in the vicinity of, each of seven
abandoned drainage ditches (see Exhibit A).
7. The areas on the Site which were filled as described in
Paragraph 6, above, were in whole or in part waters of the
-United States (wetlands), which came under the
jurisdiction of EPA and the U.S. Army Corps of Engineers (
n the Corps") effective September 1, 1976, and consisted
of mangrove forest, salt flats, and herbaceous marsh.
8. On May 5, 1995, the U.S. Army Corps of Engineers ("the Corps
n ) issued a Cease and Desist Order to Respondent for, the activ
described in Paragraph 6, above.
9. By letter dated May 19, 1995, the Corps transferred lead
agency status for this case to EPA in accordance with the
Memorandum of Agreement between the Corps and EPA concerning
enforcement of Section 404 of the Act on the grounds that
Respondent is a repeat violator of Section 404 of the Act.
Because this letter was not received by EPA, a second letter
of the same nature was sent to EPA on July 27, 1995.
10. By facsimile-message dated September 8, 1995, EPA
requested the assistance of DNER in resolving the violation with
further enforcement action by EPA.
11. By letters dated November 27, 1995 to the PRDA and
DNER, EPA requested a meeting with these agencies to
facilitate voluntary resolution of the violation.

12. On December 13, 1995, EPA met with the PRDA, DNER, and
Respondent to discuss means to resolve the violation.
13. During the period from March 6 to 8', 1996, EFA
inspected the Site and met with Respondent, the PRDA,
DNER, the Corps, the U.S. Fish and Wildlife Service
("FWS"), and the Natural Resources Conservation Service
("NRCS") to assess the extent of the violation, determine
the scope of impacts to waters of the United States, and
further discuss means to resolve the violation.
14. The Act, 33 U.S.C. §1291 et seq., confers jurisdiction
over navigable waters" which are defined as "waters
of the United States" (33 U.S.C. §1362 (7)).
15. Section 301 (a) of the Act, 33 U.S.C. 51311 (a),
prohibits the discharge of pollutants into waters of
the United States except as in compliance with
Sections 301, 306, 307, 318, 402, and 404 of the Act.
16. Respondent is a "person'' within the meaning of
ings, EPA alleges Respondent to
be in violation of Section 301 of the Act, 33 U.S.C.
$1311. Respondent admits the jurisdictional allegations
of this Order. Respondent neither admits) nor denies
the factual allegations contained in this Order
concerning its alleged violations.

21. Each day that the subject activities remain
unauthorized by the Corps pursuant to Section 404 of
the Act, 33 U.S. C. $1344, constitutes an additional day
of violation of Section 301 of the Act, 33 U.S.C. $1311.
III. SETTLEMENT ORDER ANDii i CONSENT
Based upon the foregoing Stipulations and Findings,
and pursuant to the provisions of Section 309 (a) of the
Act, 33 U. S. C. $1319 (a), EPA hereby orders and Respondent
hereby consents that:
1. Respondent shall cause no further discharges of dredged
or fill material into waters of the United States,
including wetlands, except as authorized by a valid permit
issued by the Corps pursuant to Section 404 of the Act, 33
U.S.C.$1344.
2. Within 60 days of execution of this Order, Respondent
shall have completed the following preliminary
restoration measures:
a) Removal of the roadway, described in Paragraph 6a of
the Findings, which was previously the southern outer
dike of the Aguirre Sugar Mill wastewater disposal
area. Removal of this roadway shall be conducted in
such a manner that the resulting grade of the land is
level with the grade of the wetlands located on its
north and south sides. Respondent shall have also
removed all fill material which has eroded from the
roadway onto the adjacent wetlands to the north and
south. The fill material which is removed shall be
disposed of at an upland (i.e., non-wetland) location,
or may be used as backfill for filling drainage
ditches as described below.
b) Backfilling of all drainage ditches on the Site which
are located within the JBNERR or direct runoff into the
JBNERR. Backfilling shall be conducted such that the grade
of the filled ditches is level with the grade of the land
in adjacent wetlands. Material for backfilling of the
ditches may include material which was sidecast onto
adjacent, cleared areas as described in Paragraph 6c of
the Findings, above, or material from removal of the
roadway as described in Paragraph 3a, above. Any material
imported to the site for backfilling must include only
clean soil.

c) Removal of all debris, side-casted material, and fill
from the entirety of all areas on the Site in which
side-casting of excavated soils, spreading of soils
and vegetative debris, and/or discharge of fill has
been conducted during the three years preceding
issuance, and/or subsequent to issuance, of the Cease
and Desist Order for the subject activities on May 5,
1995.
Respondent shall have leveled the grade of these areas in
their entirety to the grade of adjacentwetlands. These
preliminary restoration measures may be supervised, and/or
inspected upon their completion by EPA or by
representatives of DNER, the Corps, FWS, or NRCS, acting on
EPA's behalf. If the completed work is deemed by EPA to be
in non-compliance with the conditions of this Paragraph,
EPA may direct further fill removal or regrading, and
Respondent shall complete this work, as directed, within 7
days.
3. Within 30 days of commencement of the first local wet
season (which commencement shall be the first day of
May of any given year) following completion of the
preliminary restoration measures described above,
Respondent shall have seeded all areas described in
Paragraphs 2b and 2c, above, by spreading mangrove
propagules over the entire areas. Mangrove propagules
shall be of the species Avicennia ~erminans and/or
Laauncularia racemosa.
4. Within 3 mónths of execution of this Order, Respondent
shall submit to EPA a plan for creation of new
mangrove
wetlands at a site, to be referred to
hereafter as the Compensatory Mitigation Site (ECUS"),
no smaller than two acres, which is not presently
waters of the United States. The plan must include
sealed engineering drawings describing measures that
Respondent will take to excavate and regrade the CMS
such that the area will have proper hydrology for
growth of mangroves. If so directed by EPA, Respondent
shall revise this plan or submit a new plan with an
alternative site, as per EPA's -instructions, and
resubmit it to EPA within 30 days of receiving EPA's
directions for such revisions.
5. Within 60 days of written approval of the plan or of
the revised plan by EPA, Respondent shall have completed
excavation and regrading of the CMS as described in the
EPA-approved plan.

6. Within 30 days of commencement of the first local wet
season (which commencement shall be the first day of
May of any given year) following completion of
excavation and regrading, Respondent shall have
planted the CMS in its
entirety with mangrove seedlings at a density of one
every three feet. Respondent shall have also spread
mangrove prop les ouster the EMS in its entirety.
Mangrove seedlings and propagules shall be of the
species Avicennia germinans, Laguncularia racemosa, or
Rhizophora mangle, as appropriate to the location.
Seedlings shall be approximately one-year-old, and if
the CMS is in an area inundated daily by the tides
they shall be acclimated to seawater for no less than
thirty days prior to planting.
7. Within 6 months of written approval of the plan or of
the revised plan by EPA, Respondent shall have
arranged for and successfully completed transfer of
title of the
property on which the CMS is located to DNER, and the
property shall have been legally incorporated into the
JBNERR with a special stipulation that the CMS be
protected in perpetuity as a natural area.
8. Within 30 days of planting and/or seeding, Respondent
shall submit baseline monitoring reports to EPA for
each of the areas restored on the Site and for the
mangrove wetland created in the CMS. Each baseline
monitoring report shall include color photographs of
the subject area, and as-built drawings showing the
actual planting array, species of mangroves planted,
and number of seedlings planted.
9. In the sixth month following the date of submittal of
each baseline monitoring report, and in each sixth
month -thereafter for a minimum of 5 years, Respondent
shall submit to EPA á follow-up monitoring report for
each of the areas restored on the Site and for the
mangrove wetland created in the CMS. Each follow-up
monitoring report shall include color photographs of
the subject area, and information on percent survival
of mangrove seedlings and/or percent coverage of the
area with mangroves, and the approximate average
height of mangroves. It shall also include a
description of any sub-areas within the areas, where
percent survival and growth-of mangroves has been
substantially lower or higher than average. Each
follow-up monitoring report shall provide the dates on
which photographs were taken and information was

collected. These dates must be within the 30 days
preceding submittal of-the follow-up report.
10. Respondent shall make every attempt to ensure that all
reation/ restoration of wetlands pursuant to this Order will
result in self-sustaining, healthy, functioning mangrove
wetlands. The created/restored mangrove wetlands shall be
deemed such if, for three consecutive years, greater than
80t of the planted seedlings survive or the
wetlands exhibit greater than 80t coverage with healthy
mangrove vegetation. At any time, EPA may order regrading
and/or replanting and reseeding of all or part of the
created/restored wetlands for the purpose of ensuring that
these conditions will be
et. Survival of less than 80~-
of planted seedlings or percent coverage of less than 80`
with healthy mangrove vegetation shall be cause for ordering
such regrading and/or replanting and reseeding. Semiannual
follow-up monitoring reports shall continue to be submitted
to EPA for each area of created/restored wetlands, including
the CMS, until such time that greater than 80 of the
planted seedlings survive or the wetlands exhibit greater
than 80 coverage with healthy mangrove vegetation over a
period of three consecutive years within that
created/restored area.
11. With regard to the areas on the Site restored pursuant
to Paragraph 3, above, if it is mutually agreed by EPA
and Respondent that mangroves are not growing and will
not grow successfully in any or all parts of these
areas,
and Respondent has made every attempt to ensure successful
growth of mangroves there, EPA and Respondent shall
negotiate an agreement for restoration of these areas
as wetlands Of a type other than mangrove wetlands. In
this case, the monitoring and success requirements
described in Paragraphs 9 and 10, above, shall remain
in effect
(i.e.,
semi-annual monitoring reports must be submitted
to EPA for each area until such time that greater than
80 of the planted seedlings survive or the wetlands
exhibit greater than 80 coverage with healthy wetlands
vegetation of the type intended for a period of three
consecutive years within that created/restored area) ;
and at any time, EPA may order regrading and/or
replanting and reseeding of all or part of these
created/restored wetlands for the purpose of ensuring
that the success requirements will be met.

12. As compensation for temporary impacts to waters of the
United States which have occurred due to the
unauthorized activities which are the subject of this
Order, Respondent shall comply with Paragraphs 13
through 21, below.
13. Within 60 days of-execution of this Order, Respondent
shall
physically post the boundary between Hacienda Aguirre and
the JBNERR with signs explaining that the posted area is a
protected wildlife conservation area. The exact spacing
between signposts and language of this signage shall be
determined jointly by Respondent, DNER, and EPA.
14. In consultation with EPA and DNER, Respondent shall
prepare a comprehensive hydrologic study of the Site which
describes, at a minimum: precipitation, irrigation
practices, surfacewater and groundwater sources and
movement, and surfacewater and groundwater withdrawals for
agricultural or other uses, at the Site from both a
historical and current perspective. The study shall be
designed such that it will provide information useful for
determining the expected impacts of hydrologic alterations
a. the Site on the neai~n or the mangrove forest, and
for determining what measures could be taken to provide
drainage to the agricultural fields without causing direct
or indirect impacts to the health of the mangrove forest.
The hydrologic study shall be completed within 6 months of
by execution of this Order, and shall be submitted
immediately upon completion to EPA and DNER. EPA shall
review the completed hydrologic study and provide comments
on it to Respondent and DNER.
15. Respondent shall construct a vegetated filter strip
consisting of emergent herbaceous wetlands in the area
located between the agricultural fields and the mangrove
forest at the Site. Prior to construction of the filter
strip, Respondent shall submit to EPA sealed engineering
drawings showing its proposed location and dimensions.
These drawings shall be submitted to EPA within 60 days
after receipt of EPA's comments on the hydrologic study.
If SO directed by EPA, Respondent shall revise these
drawings and/or alter the proposed location of the filter
strip as per EPA's instructions and resubmit the drawings
to EPA within 14 days of receiving EPA's directions for
such revisions. Construction of the filter strip shall
commence no later than 60 days after receipt of EPA
approval of these drawings, and shall be completed within

30 days thereafter. The filter strip shall be designed
such that it provides drainage to the agricultural fields,
absorbs pollutants from run-off water from the
agricultural fields, and does not interfere with necessary
surfacawater or groundwater input to the mangrove forest.
16. Prior to completion of construction of the vegetated
filter strip, Respondent shall prepare a plan for
monitoring hydrology and agricultural pollutants within
and to the north and south of the filter strip for a period
of no less than 5 years. This plan shall be submitted to EPA
prior to completion of construction of the filter strip. If
SO directed by EPA, Respondent shall revise this plan as per
EPA- S instructions and resubmit it to EPA within 14 days
of receiving EPA's directions for such revisions. Respondent
shall be responsible for conducting monitoring for 5 years
in accordance with the monitoring plan and shall submit
monitoring reports to EPA and DNER in accordance with this
plan.
17. Construction of the filter strip-shall not be undertaken
if it is determined by EPA, based upon information from
the hydrologic study described in Paragraph 14, above,
or other information sources, that such construction
would have An adverse-impact upon the mangrove forest
or other waters of the United States. In this case
Respondent shall be required to complete or conduct
some alternative project of equivalent scope which
would compensate for temporary impacts to waters of the
United States which have occurred due to the
unauthorized activities which are the subject of this
Order. This alternative project would be designed and
developed in consultation with EPA and DNER, with the
possible assistance of NRCS, FWS, and the Corps, and
must be approved in writing by EPA prior to its
commencement.
18. At least 2 days prior to initiation of any and all
physical work pursuant to this Order, Respondent shall
notify EPA orally as to the dates on which the work
will be conducted so that EPA may arrange to have a
representative present to oversee the work. Such representati
individual from EPA, DNER, the Corps, FWS, or NRCS.
19. Representatives of EPA, DNER, the Corps, FWS, and/or
NRCS, shall be provided access to the Site, the CMS,
and the location of thy filter strip at reasonable
times and frequency from the date of execution of this
Order until all conditions of this Order have been
fulfilled to the satisfaction of EPA.

20. If Respondent cannot comply with any of the deadlines or
requirements in this Order, Respondent shall, upon
learning of the delay or cause for a delay, promptly
notify EPA orally and shall, within 7 days of such
oral notification, notify EPA in writing of the
anticipated length and cause of the delay, the measures
taken by Respondent to prevent or minimize the delay
and a timetable by which Respondent intends to
implement these measures. If EPA and Respondent agree
that the delay is caused by circumstances beyond the
reasonable control of Respondent, such as an Act of God
or third parties not under the direction of Respondent
or the need to obtain necessary permits or approvals
where Respondent made all reasonable efforts to timely
obtain said permits or approvals, the time for
performance hereunder may be extended at the sole
discretion of EPA for a reasonable period. Neither
increased costs or expenses associated with the
implementation of this Order nor changed economic
circumstances shall be the basis for an extension of
time to achieve compliance with this Order.
21. Rejection or denial of any permits or approvals
necessary for performance of the Provisions of this
Order shall not relieve Respondent of the requirements
of this Order, but rather shall necessitate performance
by Respondent of equivalent activities FIR Ordered by
EPA.
22. EPA, at its sole discretion, may at any time instruct
Respondent to temporarily suspend implementation of any
or all parts of this Order. The cause for such
instruction may include, among others, the disclosure
of the existence or possible existence of chemical or
other contamination within an area or areas where work
will be, or is being, conducted pursuant to this Order;
or the determination by EPA based on new information or
reassessment of existing, information that the work to
be conducted or being conducted by Respondent pursuant
to this Order may adversely impact waters of the United
States. This instruction will be made by EPA in
writing, or orally with confirmation in writing within
7 days. If instructed by EPA to temporarily suspend
work, Respondent shall immediately comply with such
instruction. Respondent shall resume implementation of
this Order when and if instructed to do SO by EPA in
writing no later than 7 days after receipt of such
instruction from EPA.
23. All written information required to be submitted to EPA

pursuant to this Order shall be sent by certified mail,
return receipt requested, to:

24. Upon execution of this Order, EPA will immediately
mail a copy to the U.S. Army Corps of Engineers,
Jacksonville District, Antilles Regulatory Section, in
San Juan, Puerto Rico.
25. Respondent's compliance with the Provisions of this
Order shall resolve the alleged violation of Section
301 of the Act, 33 U.S.C. $1311, set-forth in the
Stipulations and Findings, above.
V. GENERAL PROVISIONS
1. The provisions of this Consent Order shall be binding
upon Respondent, its officers, directors, agents,
servants, employees and successors or assigns.
2. This Consent Order does not constitute a waiver,
suspension or modification of the requirements of the Act,
33 U.S.C.-id $1252 et Sect, or any regulations promulgated
thereunder, or any state or local law or regulation. This
action is taken by EPA to ensure swift compliance with the
Act. Issuance of this Consent Order is not an election by
EPA to forego any civil or any criminal
action otherwise authorized by the Act.
3. Mitigation provided pursuant to this Consent Order,
whether in the form of restoration of impacted wetlands,
compensatory mitigation, or construction of a vegetated
filter strip or similar structure, shall not be offered by
Respondent or any other person for consideration as

mitigation for any other fill, existing or proposed, for
which Respondent or another person may seek a permit from
the Corps under Section 404 of the Act.
EFFECTIVE DATE
This Consent Order shall become effective upon the date of
execution by the Director, Division of Environmental Planning
and Protection, EPA, Region II.
