Rules and Regulations Under Title 2, Chapter 15, General Laws of Rhode Island,
as Amended, Entitled "Protection of Trees and Plants Generally."
1.00. WOODS OPERATORS REGISTRATION FEE
1.01 Effective July 1, 1993, the annual fee for a person, firm, or corporation
to register as a woods operator shall be twenty five dollars ($25.00) pursuant
to Section 2-15-1 of the R.I. General Laws.
1.02 Renewals - Any person, firm, or corporation holding a
valid woods operators certificate who wishes to renew its certificate, will be
charged a twenty five dollar ($25.00) fee.
1.03 New Registrations - Subsequent to July 1, 1993, any person, firm, or
corporation registering as a woods operator for its first time will be subject
to the following fee for the first year of registration only:
(a) From July 1 through September 30, twenty five-dollars ($25.00).
(b) From October 1 through December 31, eighteen dollars and seventy-five cents
($18.75).
(c) From January 1 through March 31, twelve dollars and fifty cents ($12.50).
(d) From April 1 through June 30, six dollars and twenty-five cents ($6.25).
1.04 Renewals if Registration Lapsed - If any person, firm, or corporation
voluntarily lets his/her registration lapse for five (5) or more consecutive
years prior to seeking a renewal of his/her woods operators registration, such
person, firm, or corporation shall be regarded as a new woods operator as
specified in paragraph 1.03 above upon seeking a registration certificate. If a
person, firm, or corporation voluntarily lets his/her registration lapse for
less than five (5) consecutive years prior to seeking a renewal of his/her
registration, such person, firm, or corporation shall be charged a twenty-five
dollar ($25.00) fee for renewal in accordance with paragraph 1.02 above.
2.00 FEE FOR FILING OF INTENT TO CUT NOTICE
2.01 As provided in Section 2-15-2 of the R.I. General Laws, the Department
shall charge an administrative fee of twenty dollars ($20.00) for a woods
operator to file an intent to cut notice with the Department.
2.02 a. Where two or more contiguous parcels are owned by the same individual,
entity, partnership or corporation, and all such parcels are to be cut or sawn
at the same time; a woods operator shall pay a single fee of twenty dollars
($20.00) to file an intent to cut with the Department.
b. Where properties owned by one individual, entity, partnership, or
corporation are not contiguous, or where contiguous properties are not owned by
the same individual, entity, partnership or corporation, a separate notification
of intent to cut and twenty dollar ($20.00) fee shall be submitted for each such
parcel to be cut or sawn, whether or not they will be cut or sawn during the
same time period.
2.03 Failure to submit full payment of the administrative fee with the
notification of each intent to cut will render the notice insufficient for the
purpose of notification as required under Section 2-15-2 of the R.I. General
Laws.
2.04 An intent to cut notice and the twenty dollar ($20.00) fee will not be
required on state property administered and managed by the Department of
Environmental Management where the cutting or sawing operation is to be
supervised by Department of Environmental Management personnel.
The foregoing Rules and Regulations, after due notice, are hereby adopted and
filed with the Secretary of State this __________ day
of_________________________________, 1993, to become effective twenty (20) days
thereafter, in accordance with the provisions of Chapters 42-17.1, 2-15, and 42-
35 of the General Laws of Rhode Island, 1956, as amended.
