ARSD 46:11:12:11. Appeal of ineligibility or termination

A family may appeal the division's decision regarding ineligibility or termination of services by requesting a fair hearing pursuant to SDCL 1-26 by notifying the department in writing within 30 calendar days of receipt of the division's decision. The family shall continue receiving services until a decision is reached. Nothing in this section may be construed as indicating that the department will pay for legal fees for representing the family at a fair hearing pursuant to this section.
