The standards of performance for storage vessels for petroleum for which construction, reconstruction, or modification commenced after May 18, 1978, and prior to July 24, 1984, are those in 40 C.F.R. Part 60, Subpart Ka (July 1, 2024). A source that operates a unit subject to Subpart Ka is exempt from the obligation to obtain a Part 70 operating permit if the unit is not required to install controls and if the source is not required to obtain a Part 70 operating permit for a reason other than the source is subject to Subpart Ka. Exempted sources must still meet the applicable requirements in Subpart Ka.
