ARSD 74:36:08:123. National emission standards for hazardous air pollutants for industrial, commercial, and institutional boilers area sources

The national emission standards for hazardous air pollutants for industrial, commercial, and institutional boilers area sources are those in 40 C.F.R. Part 63, Subpart JJJJJJ (July 1, 2024). A source that operates a unit subject to Subpart JJJJJJ is exempt from the obligation to obtain a Part 70 operating permit if the source is not required to obtain a Part 70 operating permit for a reason other than the source is subject to Subpart JJJJJJ. Exempted sources must still meet the applicable requirements in Subpart JJJJJJ.
