ARSD 20:06:55:26. Group plans -- No preexisting condition for a person under the age of 19

No health policy, certificate, or plan may limit or exclude coverage based upon a preexisting condition for a person under the age of 19. Any prexisting condition waiting period for a covered person under the age of 19 must be removed no later than the first day of the plan year following September 22, 2010. This section applies to any employer based health plan, including health benefit plans subject to the provisions of SDCL 58-18-42 and plans that are either grandfathered or not grandfathered.
