(1) Failure to submit or complete requirements required under Rule 1670-08-01-.06 shall result in: (a) First Instance. The Department will issue a notice on a form approved by the Commissioner indicating the reasons for noncompliance. (b) Second Instance. If noncompliance continues for thirty (30) days after receiving the notice, the noncompliant tourism development zone shall receive a second notice indicating the continuing reasons for noncompliance. Within sixty (60) days of receipt of the second notice, the tourism development zone shall submit a plan for remediation to the commissioners of Tourist Development, Economic and Community Development, Environment and Conservation and Safety. (2) Annual. The Department shall submit all notices issued for Failure to Comply to the Chairs of the Government Operations Committee, Tennessee General Assembly, on July 1 and list on the Department’s website.
