(1) The Tennessee State Board of Cosmetology and Barber Examiners may, in a lawful proceeding with respect to any person licensed or required to be licensed, in addition to or in lieu of any other lawful disciplinary action, assess civil penalties for violation of statutes, rules or orders enforceable by the Board in accordance with the following schedule: Each individual act, and each day of continued violation, may constitute a separate violation. The amount of any civil penalty shall not exceed one thousand dollars ($1,000.00) for each violation. Violation Penalty Tenn. Code Ann. § 62-4-127(b) $0 - $1,000 (2) In determining the amount of any penalty to be assessed pursuant to this rule, the Board may consider such factors as the following: (a) Willingness of the violation; (b) Repetitions of the violation; (c) Magnitude of the risk or harm caused by the violation; and (d) Extent to which the licensee has sought to compensate any victim(s) of the violation.
