(1) Any petition for stay filed under T.C.A. § 4-5-316 shall state the grounds upon which a stay is requested with reasonable specificity and be served on all parties of record. The petition may be supported by a brief, affidavit, or other supporting evidentiary materials. (2) Any party opposing a stay may file a brief in opposition within ten days after the service of the petition for stay. (3) In deciding whether to grant a stay, the Commission shall consider and give appropriate weight to: (a) The likelihood of the success of the petitioner on appeal; CONTESTED CASES CHAPTER 1220-01-02 (b) The hardship or injury that may be imposed on the petitioner if a stay is not granted; (c) The hardship or injury which may be imposed on others if a stay is granted; and (d) The public interest.
