Commissioner’s Bulletin # B-0062-05 September 29, 2005 TO: ALL INSURANCE COMPANIES, CORPORATIONS, EXCHANGES, MUTUALS, RECIPROCALS, ASSOCIATIONS, LLOYDS, SURPLUS LINES, OR OTHER INSURERS WRITING PROPERTY AND CASUALTY INSURANCE IN THE STATE OF TEXAS AND THEIR AGENTS AND REPRESENTATIVES RE: MANDATORY DATA CALL FOR INFORMATION REGARDING CLAIMS RESULTING FROM HURRICANE RITA The Texas Department of Insurance (TDI) has coordinated with the States of Florida, Mississippi , Alabama , and Louisiana to conduct a mandatory data call for certain information related to claims resulting from Hurricane Rita. This call for data is designed to provide TDI with immediate access to information necessary to determine the financial impact of the claims related to Hurricane Rita on the various property and casualty insurers doing business in the State of Texas, including surplus lines insurers, and the property and casualty industry as a whole, Pursuant to Articles 1.15 and 1.15B, and Section 38.001 of the Texas Insurance Code, TDI hereby directs all of the above-referenced insurers, and their agents and representatives to provide data in accordance with the Insurance Disaster Reporting System Memorandum dated September 30, 2005 and jointly issued by the States of Texas, Florida , Mississippi , Alabama , and Louisiana (the "IDRS Memorandum"). The 10 day time period otherwise required for responses to inquiries made by TDI pursuant to Section 38.001(c) is hereby extended for the limited purpose of facilitating full compliance with the reporting requirements of the IDRS Memorandum and for a period not to exceed those required by the IDRS Memorandum. TDI will monitor carriers for compliance with this Bulletin. Failure to comply with the requirements of this Bulletin within the specified time periods may constitute a violation or violations of the Texas Insurance Code.
