Kiser, Utah Insurance Commissioner DATE: April 30, 2020 SUBJECT: Utah Mental Health and Substance Abuse Parity Attestation The purpose of this bulletin is for the Utah Insurance Department to notify all health insurance issuers of a new attestation required when filing a health benefit plan form. The attestation is intended to document an insurer’s compliance with the federal Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA), Pub. L. No. 110- 343, and state law, as applicable. Beginning May 1, 2020, each form filing in which the policy benefits are subject to the requirements of 42 U.S.C. § 300gg-26, 45 CFR § 146.136, and Utah Code § 31A-22-625 is required to submit the Utah Mental Health and Substance Abuse Parity Attestation. The attestation and the applicable attachments are required to be submitted through the System for Electronic Rate and Form Filing (SERFF) on the Supporting Documentation tab. A filing will be considered deficient and noncompliant if the attestation and its applicable attachments are incomplete or omitted.
