Kiser, Utah Insurance Commissioner DATE: February 8, 2013 SUBJECT: New Actuarial Filing for Property & Casualty Insurers and Related Confidentiality Provisions Utah Administrative Code (U.A.C.) § R590-264, Property and Casualty Opinion Rule, became effective July 13, 2012. The rule requires that all Property & Casualty (P&C) insurers prepare an Actuarial Opinion Summary (AOS) every year by March 15th that supports the Actuarial Opinion filed with the annual statement. Note that only Utah domestic P&C insurers need to file the AOS with the Utah Insurance Department (Department). Foreign insurers need to have the AOS available, but they do not need to file it with the Department, unless requested to do so. The National Association of Insurance Commissioners (NAIC) recommends that the AOS be kept confidential due to the nature of the information provided therein. However, this information WILL NOT BE TREATED AS CONFIDENTIAL unless filed in accordance with U.A.C. § R590-264-7.
