R657-57-8. Division Review of Variance Applications

(1) The Division will: (a) review variance applications submitted pursuant to this rule; (b) determine facts relative to variance requests; (c) apply the provisions of this rule to relevant facts; and (d) grant or deny variance requests in accordance with this rule. (2) Any variance request granted or denied shall be reviewed and approved by the Division director/designee before notice of decision is provided to the variance request applicant.
