R70-101-16. Variance

(1) The department may issue a variance on law or textile label and tag requirements. (2)(a) A permittee may request a variance from the department in writing. (b) The variance shall contain the following information: (i) the product associated with the variance request; (ii) where the variance will be used; (iii) an explanation of the need for a variance; (iv) a description of the application of the variance in practice; and (v) an example of the substitute law or textile label, or tag that will be used instead of the required label or tag. (3) The department shall approve a variance in writing. (4) A variance shall be subject to a period of review.
